Assumption of Risk, Waiver, and Release of Liability

In consideration of being permitted to participate in the 5K Ghost Run/Walk in Touisset, Rhode Island, on October 31, 2026, at 10:31 a.m. (the “Event”), I acknowledge and agree as follows:

I understand that participating in a road race or walk involves inherent and other risks, including strenuous physical activity, falls, collisions with people or vehicles, traffic, uneven or defective road surfaces, weather conditions, limited visibility, equipment failure, and the acts or omissions of other participants. These risks may result in serious bodily injury, illness, disability, property damage, or death.

I certify that I am medically able, adequately trained, and physically prepared to participate safely. I accept responsibility for determining whether I should participate and agree to stop participating if I believe conditions are unsafe or I am physically unable to continue.

I knowingly and voluntarily assume all risks associated with my participation in the Event, whether known or unknown, foreseeable or unforeseeable.

To the fullest extent permitted by Rhode Island law, I release, waive, discharge, and covenant not to sue The Community Club of Touisset Point Inc., together with its officers, directors, employees, volunteers, agents, sponsors, vendors, contractors, property owners, municipalities, and affiliated organizations (collectively, the “Released Parties”), from any claims, liabilities, damages, or causes of action arising from or related to my participation in the Event, including claims resulting from the ordinary negligence of any Released Party. This release does not apply to conduct that cannot lawfully be released, including gross negligence or willful, wanton, reckless, or intentional misconduct.

I authorize Event personnel to obtain emergency medical treatment for me when reasonably considered necessary and accept responsibility for the resulting expenses. This agreement binds me and my heirs, estate, personal representatives, and assigns. If any provision is found unenforceable, the remaining provisions will remain effective.

I HAVE READ THIS AGREEMENT, UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS, AND AGREE TO IT KNOWINGLY AND VOLUNTARILY.

I agree to the Assumption of Risk, Waiver, and Release of Liability above.

I am the participant’s parent or legal guardian. I have read and agree to this agreement individually and, to the fullest extent permitted by Rhode Island law, on behalf of the minor participant. I consent to the minor’s participation, acknowledge and assume the risks described above, and release the Released Parties from my own claims arising from the minor’s participation.
